 “ON SEPTEMBER 27, 2018 CITY OF CHICAGO DEPARTMENT OF PUBLIC HEALTH (CDPH) ENVIRONMENTAL ENGINEER III, RENATE MARANTE AND INSPECTORS FELIPE GARCIA AND JOHN SINGLER (INSPECTORS) CONDUCTED AN INSPECTION AT 4000-10 S. DAMEN AVE. FOR THE PURPOSE OF MEASURING PILES OF DEBRIS OBSERVED FROM ?GOOGLE? AERIAL MAPS.

UPON ARRIVAL AT THE SITE, A DUMP TRUCK WITH M.T. TRANSIT SIGNAGE ARRIVED AND IMMEDIATELY DUMPED A LOAD (7 CUBIC YARDS) OF CONSTRUCTION AND DEMOLITION DEBRIS WASTE. INSPECTOR SINGLER PROVIDED TO THE DRIVER, CITY OF CHICAGO CREDENTIALS. THE DRIVER WAS ASKED TO REMAIN ON SITE, BUT DROPPED THE BUCKET AND SPED OFF DURING THE CONVERSATION.

A SECOND TRUCK ARRIVED WITHIN MINUTES OF THE INITIAL VISIT, WITH THE SAME VERBIAGE ON THE SIDE OF THE TRUCK.THE SECOND TRUCK DUMPED A LOAD OF STONE. THE SECOND DRIVER AGREED TO REMAIN ON SITE WHILE THE CHICAGO POLICE WERE CONTACTED FOR THE PURPOSE OF VEHICLE IMPOUNDMENT. THE SECOND DRIVER LEFT THE SCENE AFTER DUMPING HIS LOAD OF STONE AND WAITING APPROXIMATELY TEN MINUTES. THE DRIVER WAS QUESTIONED AS HE WAS LEAVING THE PROPERTY AS TO WHO GAVE HIM PERMISSION TO LEAVE DURING A POLICE ACTIVITY, AND THE DRIVER STATED THAT HIS SUPERVISOR TOLD HIM TO LEAVE THE SITE.

WHILE ON THE SITE, THE INSPECTORS OBSERVED 400-500 CUBIC YARDS OF ILLEGALLY DUMPED MIXED C  D DEBRIS WASTE (CONSISTING OF DIRTY SAND, SOIL, CLAY, CONCRETE PIECES, BRICKS, WASTE WOOD,AND GRAVEL), 50 CUBIC YARDS OF CONCRETE PIECES, 160-200 CUBIC YARDS OF DIRTY SAND, 600 CUBIC YARDS OF STONE/ASPHALT GRINDINGS, AND 400,000 CUBIC YARDS OF LIMESTONE MATERIAL.

FOLLOWING THE TWO DUMPING INCIDENTS, MICHAEL A. TADIN, PRESIDENT, T B LTD., OF 4450 S. MORGAN, CHICAGO, IL 60609 ARRIVED AT THE SITE. TADIN, AND TWO OF HIS SUBORDINATES, THE REPORTING INSPECTOR AND MARANTE DISCUSSED CITY OF CHICAGO REGULATIONS FOR STOCKPILING AND DUMPING DEBRIS. TADIN TOLD INSPECTORS THAT THE HUGE PILE OF LIMESTONE CAME FROM A DEEP TUNNEL PROJECT A FEW YEARS AGO. TADIN AGREED TO MEET AT THE CDPH OFFICES TO DISCUSS PERMITTING FOR THE SITE. THE PROPERTY IS OWNED BY MR. TADIN UNDER T B LTD.

WE THEN ISSUED T B LTD NOV CITATION #E000035119 12 FOR DUMPING ON REAL ESTATE WITHOUT A PERMIT (7-28-440) AND FOR WASTE HANDLING FACILITY/PERMIT REQUIRED (11-4-250). WE ALSO ISSUED THEM CITATION #E000035120 13 FOR TREATMENT AND DISPOSAL OF SOLID WASTE (11-4-1500) AND FOR PERSON RESPONSIBLE FOR THE WASTE REMOVAL (11-4-1585[A]). THE HEARING DATE FOR THE CITATIONS WILL BE ON NOVEMBER 29, 2018 AT 1:00 P.M. AT 400 W. SUPERIOR ST. MR. TADIN SIGNED FOR THE CITATIONS.”
